Terms of Use

1. Agreement to Terms

By downloading, accessing, or using the WorkPlace Time Keeper mobile application ("App") or associated website ("Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or Site.

2. Usage License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial time tracking purposes, subject to these Terms.

• The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
• You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use.
• You are responsible for maintaining the confidentiality of your device and for restricting access to it to prevent unauthorized use of the App.

3. Data Storage and Responsibility

Your work session data is stored locally on your device. You have the option to sync this data using Apple's iCloud service.

• You are solely responsible for the accuracy, management, and backup of your data.
• If you enable iCloud sync, your data will be stored in your personal iCloud account according to Apple's terms and privacy policies. We do not have access to your iCloud data.
• We are not liable for any loss or corruption of your data, whether stored locally or synced via iCloud.
• The App allows you to export your data. We recommend regular exports as a backup measure.

4. Functionality and Limitations

While we strive to provide accurate time tracking, certain limitations apply:

• The App may experience occasional downtime for maintenance or updates.
• Features like break tracking and travel time are based on manual input and device capabilities; accuracy may vary.
• iCloud sync performance depends on your internet connection and Apple's service availability.
• Overtime calculation accuracy depends on the correct configuration of your work schedule within the App.

5. Your Responsibilities

As a user, you agree to:

• Maintain the security and integrity of your device.
• Keep the App updated to the latest version available on the App Store.
• Use the App in compliance with all applicable laws and regulations, as well as any relevant workplace policies.
• Manage your data, including performing regular backups or exports if desired.

6. In-App Purchases

The App offers optional in-app purchases (e.g., Tips, Leave Management feature).

• All purchases are processed securely through Apple's App Store platform using your Apple ID. We do not handle or store payment information.
• Purchases are subject to Apple's App Store terms and conditions. Refunds, if applicable, must be requested through Apple.
• Optional tips are voluntary contributions to support development and do not grant additional features beyond those explicitly stated.

7. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.

8. Disclaimer of Warranties

THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP OR SITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP OR SITE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer is based, without regard to its conflict of law principles.
